We Are Experienced In These Areas…
Workers’ Compensation
Workers’ compensation insurance provides benefits for wage loss, medical expense, permanent injury, and rehabilitation benefits to an employee injured, while in the scope and the course of their employment. Dependent benefits are available to an employee’s family when a work-related injury results in an employee’s death.
Workers’ compensation is not the same as health insurance or disability insurance, but a separate system. State law determines the benefits payable and the system for payment of workers’ compensation. The workers’ compensation court system is different than the one set up for personal injury and other civil claims.
It is important for the employee or their family to know what the differences between the systems are in order to know what benefits they may be entitled to receive. The employer and its workers’ compensation insurance company are more concerned with the expense to them resulting from a workers’ compensation claim, and try to minimize that expense even if doing so may be harmful to the employee or their family. Consultation with an attorney is often necessary to obtain proper benefit information and payment.
Personal Injury
Here are some examples of serious accidents:
A person injured in a serious accident can potentially sue for the injuries and damages sustained. Each state has different laws that may affect the parties sued and the damages that can be obtained.
Compensation can be based on fault, no-fault, or a blend of each. Different laws may apply depending upon several factors, including the exact nature of the accident, the location of the accident, the residency of the parties, and the negligence involved.
We have extensive experience in representing individuals seeking compensation due to injuries obtained in serious accidents.
Social Security Disability
If you are disabled, either due to mental health issues or physical health issues or some combination, you may be entitled to Social Security Disability Benefits. The Social Security Disability process can be complicated and overwhelming.
The definition of disability for Social Security purposes requires that the disability last for 12 months or more or be expected to result in death and cause an inability to engage in any substantial gainful activity.
A denial of benefits by the Social Security Administration may mean additional information or documentation of your disability is needed. An attorney will be very helpful in assembling the information Social Security is looking for.
Representation is very important, particularly at the Hearing level. Early representation at the Reconsideration level is beneficial in order to allow sufficient time to develop the medical support needed for a successful claim.
